Consumer consent
Consent to do business electronically
This is the UETA / ESIGN consumer consent disclosure used on every Upstate Sign request. You also see it on the signing page before any signature is applied.
U.S. ESIGN Act (15 U.S.C. § 7001) · New York ESRA · Illinois UETA (815 ILCS 333) · Washington UETA (RCW 1.80)
Consent version ESIGN-ESRA-2026-10-13
What you are agreeing to
- You are being asked to review and sign “the document you are asked to sign” for the sender. Under federal ESIGN, New York ESRA, Illinois UETA, and Washington UETA, an electronic signature is an electronic sound, symbol, or process attached to or logically associated with an electronic record and executed or adopted by a person with the intent to sign the record. It has the same force and effect as a signature affixed by hand.
- Federal ESIGN applies to interstate commerce in every state. New York, Illinois (including Chicago), and Washington each have their own e-signature statutes. The same consent, intent, audit, and copy rules apply to signers in those states.
- Use of an electronic signature is voluntary. You may decline and request a paper copy from the sender before you sign. Closing this page before you type I AGREE withdraws consent to do this transaction electronically.
- You will be able to review the entire document on this screen before any signature is applied. You cannot sign until you have consented, drawn or typed your mark, typed your legal name, and typed the words I AGREE. That process is the electronic signature.
- The system keeps your signature logically associated with this record during storage: your identity, how and when you were authenticated, your consent, your intent statement, date and time of signing, IP address, browser, SHA-256 hashes of the original and completed files, and a certificate of completion. The completed record can be accurately reproduced as a PDF or on paper.
- You need a current web browser that can display this PDF, and a mouse, trackpad, or touchscreen if you draw a signature. Opening this page and viewing the PDF shows you have the technology required to sign electronically. After you sign you will receive a fully executed copy you can download, and you may ask the sender for a paper copy.
- If you do not want to sign electronically, use Sign on paper instead. Download the unsigned PDF, print it, sign in ink, and return it to the sender. That is the opt-out path. Closing this page before you type I AGREE also withdraws electronic consent.
Standard clause
The parties agree that this agreement may be electronically signed. The parties agree that the electronic signatures appearing on this agreement are the same as handwritten signatures for the purposes of validity, enforceability, and admissibility.
How to opt out and sign on paper
- On the signing page, choose Sign on paper instead before you type I AGREE.
- Download the unsigned PDF, print it, and sign in ink.
- Return the paper to the sender. Keep a copy.
Closing the signing page before you type I AGREE also withdraws electronic consent. After you sign, the electronic record is retained and can be downloaded or printed.
